Operations over people: the four drone categories explained

Drone operations over people run through four categories under Part 107. What each one requires, how they differ, and which one your aircraft qualifies for.


Drone operations over people are permitted under Part 107, but only through a structure that most operators meet as a wall before they meet as a pathway. The baseline rule prohibits flight over a human being unless that person is directly participating in the operation or is under a covered structure or inside a stationary vehicle. Everything beyond those two exceptions runs through four categories, and which one applies is decided by the aircraft rather than by the pilot or the job.

This article sets out how the categories are structured, what each one requires of the airframe and the operation, the open air assembly restriction that cuts across all four, and how an operator establishes which category a given aircraft qualifies for. The answer is usually written on a label the buyer never looked at.

The rule that routes you into a category

The routing provision is short. Under 14 CFR 107.105, and except for the participating persons and sheltered persons exceptions and the separate provision covering moving vehicles, a remote pilot in command may conduct operations over human beings only in accordance with the section governing Category 1, the pair of sections governing Category 2, the pair governing Category 3, or the section governing Category 4. There is no general permission and no discretionary route around the four.

The categories are ordered by how the risk is controlled rather than by how permissive they are. The first three limit the energy the aircraft could transfer to a person on impact, on the reasoning that a lighter or less injurious aircraft presents less consequence if it falls. The fourth takes a different approach entirely and limits the probability of it falling, by requiring an airworthiness certificate and a maintenance regime. Understanding that split explains why the requirements look so different from one end of the list to the other.

Categories 1 through 3: energy, labels, and declarations

Category 1 is the simplest and the most restrictive on hardware. The aircraft must weigh no more than 0.55 pounds on takeoff and throughout the operation, including everything attached, and must have no exposed rotating parts that would lacerate human skin. Nothing needs to be declared or labeled, because the qualifying properties are self evident from the aircraft. That threshold excludes most commercial airframes and includes a number of sub 250 gram aircraft used for confined interior and close quarters work.

Categories 2 and 3 open the door to heavier aircraft through a manufacturer led process. A Category 2 aircraft must be designed, produced, or modified so it will not cause injury equivalent to or greater than the transfer of eleven foot pounds of kinetic energy from a rigid object, must have no exposed rotating parts that would lacerate skin, and must have no safety defects. Category 3 raises the energy threshold to twenty five foot pounds with the same laceration and defect conditions. Both require the aircraft to appear on an FAA accepted declaration of compliance and to carry a permanent label identifying the category it qualifies for.

What Category 3 restricts and what Category 4 demands

The higher energy allowance in Category 3 comes with operational limits the lower category does not carry. A Category 3 aircraft may not operate over open air assemblies at all, and it may only fly above a human being in one of two situations: within or over a closed or restricted access site where everyone inside has been put on notice that a drone may fly over them, or without maintaining sustained flight over any person who is not participating or sheltered. That makes Category 3 a construction site and industrial facility permission rather than a public space one.

Category 4 sits in a different world. The aircraft must hold an airworthiness certificate issued under the certification rules and must be operated within the limitations of its approved flight manual, which must not prohibit operations over people. Maintenance, preventive maintenance, alterations, and inspections must follow the manufacturer's instructions, performed by someone with the knowledge, skill, and equipment to do the work, with records kept of what was done, when, and by whom. Life limited part status, inspection status, and airworthiness directive compliance must be retained and transferred with the aircraft on sale.

Finding out which category you really hold

Most operators overestimate what their fleet permits. A popular inspection airframe is usually well above the Category 1 weight and frequently has no accepted declaration behind it for Categories 2 or 3, which means it cannot lawfully be flown over people at all outside the participating and sheltered exceptions. The check is straightforward: look for the permanent label on the aircraft, and confirm the model appears on the FAA's published declaration list. Where the label is damaged, destroyed, or missing, the pilot in command is required to label the aircraft correctly before conducting operations over people.

One further wrinkle matters for aircraft with configurable payloads or parachute systems. An aircraft may be eligible for more than one category provided the pilot cannot inadvertently switch between modes or configurations, which means the category depends on how the aircraft is set up on the day rather than on the model name. A parachute fitted configuration and the same airframe without it are not necessarily the same category, and the record for a flight over people needs to capture the configuration flown alongside the category claimed.

Common mistakes in operations over people

Assuming a small aircraft qualifies. Category 1 requires 0.55 pounds or less including everything attached. A great many aircraft described as small sit well above that and need a declaration to fly over anyone.

Confusing weight with category. Categories 2 and 3 are defined by kinetic energy transfer and the absence of safety defects, established through an accepted declaration, not by a weight the operator measures.

Flying Category 3 over an assembly. Category 3 aircraft may not operate over open air assemblies at all, and outside a closed or restricted access site they may not maintain sustained flight over anyone.

Ignoring the configuration. An aircraft eligible in more than one category depends on how it is configured. Record what was fitted for the flight, not just which model flew.

Treating the label as decoration. The label is the operational proof of category eligibility, and a missing one obliges the pilot in command to relabel correctly before flying over people.

The four categories look complicated until you notice they answer one question in two different ways: how much harm could this aircraft do if it fell, or how confident are we that it will not fall. Categories 1 through 3 take the first route through energy limits and manufacturer declarations, and Category 4 takes the second through certification and maintenance discipline. Which route an operator can use is decided at purchase, which is why the category question belongs in the procurement conversation rather than in the preflight brief.
